Abstract:
The Digital Personal Data Protection Act, 2023 (DPDP ACT) is a Landmark legislation enacted by India to safeguard the privacy of individual in the digital era. The act seeks to regulate the processing of digital personal data while ensuring the balance between the right to privacy and the needs of innovation and economic growth. This paper examines the scope, objectives, key provisions, and legal framework of the act. It also analysis the challenges in its implementation, such a broad government exemption, lack of regulatory Independence and Limited rights of data principals. Further, the paper suggests legal reforms to strengthen India's data protection regime in line with international standards like the GDPR.
